Lawmakers try to curb anonymous political donations in California

SACRAMENTO ? State lawmakers are moving to curb anonymous political donations in California after a national election in which nonprofit groups secretly poured hundreds of millions of dollars into campaigns.

Legislators have proposed greater disclosure by donors, higher fines for violations and new powers for officials to investigate suspicious contributions to certain groups. Other measures would boost disclosure requirements for political advertising and campaign websites.

The moves were prompted largely by an Arizona group's $11-million donation this year to a California campaign committee, which used the money to oppose Gov. Jerry Brown's tax-hike measure and support another ballot initiative that was intended to curb unions' political fundraising.

State election officials sued the Arizona group to determine the identities of the contributors ? only to discover that the money had come from two other nonprofits, which under federal law are not required to reveal their donors. State law requires groups to identify only donors who gave money specifically for political purposes.

Ann Ravel, chairwoman of the Fair Political Practices Commission, said new legislation is necessary to update the Political Reform Act, the Watergate-era law that governs campaign finance in the state.

Amendments to the 1974 law require a two-thirds vote. It is unclear whether California Democrats, who now wield historic supermajorities in both houses of the Legislature, will use their newfound powers to make the proposed changes.

State Sens. Leland Yee (D-San Francisco) and Ted Lieu (D-Torrance) have introduced legislation, SB 3, to close the state loophole for nonprofits. Their bill would require nonprofits that give at least $100,000 to a political campaign over the course of a year to release the names of the donors behind the contribution.

"Laundering money through nonprofits in an attempt to avoid transparency is fundamentally undemocratic," Yee said. "Our democracy should not be bought and sold in shady backroom deals."

The rise of so-called dark money is a byproduct of the U.S. Supreme Court's 2010 ruling in Citizens United vs. Federal Election Commission, which lifted the ban on direct political expenditures by corporations. That triggered a surge of election activity by groups incorporated under the tax code's section 501(c)4 as social welfare organizations, which are allowed to engage in issue advocacy.

Advocates for more campaign finance reporting said they have been pushing lawmakers for years to tighten California's disclosure rules, which are already among the strongest in the nation.

"It took $11 million to get their attention," said Phillip Ung, a policy advocate at Common Cause, which filed the original complaint about the Arizona donation. "Campaign strategists are constantly adapting their strategies to sneak as much money into campaigns from secret donors as possible, and the law needs to keep up with those strategists."

Assemblyman Roger Dickinson (D-Sacramento) has legislation, AB 45, to prevent what he called last-minute "money bombs" in elections. It would require nonprofits participating in a political campaign to identify any donors giving at least $50,000 six months before an election.

"This is the kind of information voters and the public need to have before they cast their votes," Dickinson said.

The bill would also empower the state's political watchdog to seek injunctions against nonprofits to compel disclosure.

Other proposals target political advertising.

State Sens. Mark Leno (D-San Francisco) and Jerry Hill (D-San Mateo) have introduced SB 52, which would require the top three funders of political ads to be identified in the spots and on the campaign's website.

Another bill, SB 26 by state Sen. Louis Correa (D-Santa Ana), would increase the size of the disclosure notice on slate mailers, which are paid advertisements for candidates and ballot measures, telling voters who prepared and promoted the fliers.

Linux On The Microsoft Surface Won't Be Easy

If you were hoping you would be able to run your favorite Linux distribution on Microsoft's new Surface Tablet, it doesn't look like it will be an easy task to accomplish.

After going through the state of Linux distributions handling SecureBoot, UEFI-guru Matthew Garrett confirmed via his blog that Linux on the Microsoft Surface is likely a lemon.

The challenge with loading Linux (or any non-Microsoft operating system) on the new ARM-based tablet is that while it implements UEFI SecureBoot, it doesn't have the "Microsoft Windows UEFI Driver Publisher" key. This is the key used to sign Windows drivers and other non-Microsoft software (e.g. the signed Linux UEFI boot-loaders). Microsoft meanwhile has its own private key and this is the only UEFI SecureBoot key present on the Surface. Without the Surface having the "Microsoft Windows UEFI Driver Publisher" standard key, it's simply not a matter of having OS boot-loader be signed already to have support for this tablet. Microsoft only wants its OS on their tablet.

The Microsoft Surface tablet is based upon NVIDIA's Tegra 3 (T30) SoC with quad-core ARM Cortex-A9 1.3GHz processor, 2GB of RAM, storage capacities of 32GB or 64GB, and runs the Windows RT operating system. Being based upon the common NVIDIA Tegra 3 SoC, the hardware itself isn't too attractive or unique. You can already find plenty of other Tegra 3 tablets on the market capable of running Android/Linux like the ASUS Eee Pad Transformer Prime, Google Nexus 7, Lenovo IdeaPad Yoga 11, and NVIDIA's Cardhu reference tablet.

As Matthew mentions in his post, loading Linux or any other operating system to this first-generation ARM-based Microsoft Surface tablet would likely involve finding a vulnerability within the device's firmware in order to execute arbitrary code.

With the sobriety test, and fare estimator, the company is giving users all the information they need to decide if a pricey car ride is worth the splurge. The sobriety test is particularly interesting, and I wonder if this will become more widely used in the app. Ride-sharing app SideCar also warned users today of its surge pricing that will take place on New Year’s Eve.

New, gentler snowstorm heads for Northeast

It won't be a blockbuster snowfall, but most of the big cities in the Northeast will get one to three inches of snow. The Weather Channel's Chris Warren reports.

As airlines dig out from the massive storm that grounded thousands of flights and affected hundreds of thousands of holiday travelers earlier this week, a new system is expected to deliver up to 4 inches of snow in major cities across the Northeast on Friday night and into Saturday, while some less populated areas could see a foot and a half of snow.

The system isn?t shaping up to be as deadly or disruptive as the one that just exited the Northeast.?"This storm will move at a rather brisk pace, so we don't expect any overwhelming snow amounts," weather.com reported.

New York City can expect 2-4 inches Saturday morning and into the evening, NBCNewYork.com reported, calling it a "postcard" storm ideal for sledding and strolling.

Washington, D.C., is looking at 1-3 inches, NBCWashington.com was forecasting. Some of that snow is likely to mix with rain.


Freezing rain -- making for treacherous travel conditions -- was predicted for parts of Maryland, Pennsylvania, Virginia and West Virginia while significant rain was likely along the New Jersey, Virginia and Maryland coasts, the?National Weather Service?said.

The weather service forecast 12 to 18 inches of snow for northern New England, accompanied by freezing rain and sleet.

Tom Olney, a 50-year-old stay-at-home father of two, was making plans to go sledding with his children in their hometown of Wayland, Mass.?

"We love snow," Olney told Reuters. "What else are you going to do when it's this wet and cold out?"?

Western Massachusetts, like much of the Northeast, had an uncharacteristically mild winter last year, but residents such as Olney say they are ready for a more typical cold season.?

"Mother Nature doesn't usually give you two in a row," he said. "We've still got a lot of supplies from last year, so I guess we're ready for it now."?

Eleven inches of snow was forecast for Buffalo, N.Y., where some 8 to 12 inches of snow fell overnight into Thursday. Prior to that, Buffalo was 23 inches below average for this time of year, the weather service said.

"It's just a reminder: Winter is here," said Tom Paone of the National Weather Service in Buffalo.

The earlier winter storm was tied to at least 17 deaths and?forced the cancellation of thousands of airline flights. It?dumped record snow in north Texas and Arkansas before sweeping through the South on Christmas Day and then veering north where the Adirondacks got 20 inches of snow.

More than 2,000 flights have been canceled, and more than 200,000 customers are without power in several Southern states as the impact of severe winter weather was felt across the nation. NBC's Eric Fisher reports.

It also triggered tornadoes and left almost 200,000 homes and businesses in Arkansas and Alabama lost power on Wednesday.

In Arkansas, 135,000 homes and businesses were still without power Friday morning, and the state's largest utility said many might not get it back until after Jan. 1. Freezing rain was expected Friday, making it harder for utility crews to repair lines.

Deena Brazell spent a night in her car for warmth, though she hadn't planned it that way.

"Everything in the apartment is electric. I stayed in the apartment the first night. After that, it got cold really quick," she told The Associated Press. "I went out to charge the phone and fell asleep, then I just decided to stay."?

Rewind 2012: In film, reality takes a vacation

From Bond to Batman, Hushpuppy to Django, film turned to fantasy in 2012, and fantasy got a reality check. It?s in the blurring of the lines in between that movies find their magic.

I?m not (just) talking hocus-pocus, but the je ne sais quoi that makes a film resonate, excite and enthrall. Movies have long been celebrated for their ability to sweep us away. But if that?s all there was to it, we?d get bored quick.

Which is what made some of the year?s biggest blockbusters stand out. The Hunger Games introduced an alternate universe where kids battle to the death for reality TV-style entertainment, but gritty establishing scenes of life in the district where heroine Katniss (Jennifer Lawrence) is from gave the film a crucial dose of serious.

The Dark Knight Rises closed Christopher Nolan?s Batman trilogy with a brooding, quasi-apocalyptic touch. Bruce Wayne (Christian Bale) begins the film beaten down and depressed, hiding from the world as he struggles with his inner demons. Even when Batman emerges to fight for justice, Nolan doesn?t lift the oppressive weight resting on his protagonist?s shoulders. It makes for a better film; in fact, it makes the film.

Much like Sam Mendes?s revitalized James Bond epic, Skyfall. Taking considerable time to delve into 007?s backstory, Mendes imbues the mythical secret service agent with a crucial element of edge.

What fun is a hero who shows no sign of weakness? In Skyfall, Daniel Craig?s Bond is downright unfit for duty in the early stages, while the film?s climactic third act has him returning to face his painful past.

Stripped of modern gadgets and gimmicks, the grand finale is a statement about the timelessness of good old tried-and-true drama over explosions and special effects ? though we get our share of those, too.

On the flip side, several of the year?s most engaging movies borrowed freely from the land of make-believe. Benh Zeitlin?s spectacular Beasts of the Southern Wild was, on the one hand, a devastating reality-based tale about a young girl named Hushpuppy (Quvenzhan? Wallis) who lives with her drug-addicted father in the hurricane-prone backwaters of the Louisiana bayou. Told through her eyes, the film uses prehistoric animals called aurochs as a recurring motif, along with a heart-swelling soundtrack to give her journey a larger-than-life feel. The combination made for the most mesmerizing movie experience of the year.

While he didn?t indulge in fantasy, Quebec director Kim Nguyen allowed for some respite in Rebelle, his tough tale of child soldiers in sub-Saharan Africa. The violence of the film is unflinching, but Nguyen elevates his story via the romance between protagonist Komona (Rachel Mwanza) and fellow child soldier Magicien (Serge Kanyinda). He brings nuance to his story by contrasting the intolerable cruelty suffered by these children with glimpses of the carefree life they should be living.

The balance resonates. Rebelle has racked up accolades internationally, winning best actress (Mwanza) and a special mention from the ecumenical jury at the Berlin International Film Festival; taking best film and best actress at New York?s Tribeca Film Festival; and earning a spot on the nine-film short list for the Oscar for best foreign-language film (the five nominees will be announced Jan. 10).

Quentin Tarantino didn?t let the facts get in the way of a good time as he mined another shameful historical period (following his Nazi Germany remix, Inglourious Basterds) in Django Unchained. Taking inspiration from blaxploitation flicks and spaghetti westerns, his delightfully outlandish revenge fantasy finds a freed slave (Jamie Foxx) and a German bounty hunter (Christoph Waltz) pulling off a guns-blazing rescue mission in the pre-Civil War deep south.

And yet, rooting the story beneath the tomfoolery are the very real indignities suffered by black people a mere century-and-a-half back. That tension ? and the fearless breaking of the social codes of the time ? is at the heart of the film?s twisted humour and giddy appeal.

There is very little reality beyond the awkward idealism of childhood in Wes Anderson?s awesome Moonrise Kingdom. And yet by sticking tightly to the deadpan determination of his young protagonists, he captures a different kind of truth.

When the dismissal of realism is so complete, a story can play by its own rules. The catch is that it has to hook us somewhere along the way; we have to believe it, even if only according to its own skewed internal logic.

Which is the premise of another of the year?s big movies, Ang Lee?s fantastical adaptation of Yann Martel?s Life of Pi. The nature of storytelling is at the heart of Martel?s tale, and Lee?s effects-laden film gives substance to its most outlandish elements. When all is said and done, the truth is still up for grabs.

?I can only tell my story,? says the grown-up Pi. ?After that, you will decide what you believe.?

Sarah Polley put her finger on it with Stories We Tell, her fascinating documentary revealing a long-hidden family secret. Interviewing family members and friends, one by one, the Canadian director shows the truth to be a slippery sucker.

Somewhere in the midst of her interviewees? diverging accounts of events, we get a piecemeal collage of what happened. It?s precisely in that grey area, where things are uncertain, that the story is most intriguing.

Leave it to a documentary to teach us a lesson about our individual need for fiction ? our tendency to make things up, to imagine or remember events as best suits our needs.

In the end, fact and fantasy are equally necessary. The best stories, and the best films, strike a balance.

No fewer side effects for prostate proton therapy -Prostate Cancer ...

An expensive prostate cancer radiation treatment known as proton beam therapy has just as many side effects as a more common and cheaper radiation method, according to a new study.

In terms of side effects, ?In the long term, there?s really no difference in outcomes between proton radiation and IMRT for men with prostate cancer,? said lead author Dr. James Yu, a radiation oncologist at Yale University School of Medicine in New Haven, Connecticut.

Proton therapy advocates argue that protons blast radiation directly to the tumor and therefore avoid side effects. The more common ?intensity-modulated? radiotherapy (IMRT) exposes some healthy tissue to radiation that researchers hypothesized would increase side effects and even additional cancers.

After a year, however, the study found the same number of side effects among men who?d had both treatments.

Prostate cancer, the most common cancer in men, kills about 28,000 Americans each year. However, many men don?t die of the disease, because many tumors grow very slowly.

Treatments include chemotherapy, hormone therapy, surgery, and frequent surveillance - aka ?watchful waiting.?

Although researchers are at odds over which treatment - proton therapy or IMRT - is the better option for men who choose radiation, that hasn?t stopped the growth of proton beam centers. There are ten such centers in the U.S., according to the National Association for Proton Therapy, with eight more under development or being built.

Each one can cost more than $125 million, and Medicare pays doctors about twice as much for proton therapy.

For the study in the Journal of the National Cancer Institute, researchers tracked Medicare claims in 2008 and 2009 for treatment-related complications in nearly 28,000 men with prostate cancer for up to a year. Only two percent of the prostate cancer patients underwent proton therapy and the remainder had IMRT.

After six months, nearly 10 percent of IMRT-treated patients, and six percent of proton therapy patients, had side effects including incontinence, a burning sensation while urinating or difficulty getting an erection. However, the difference disappeared a year after treatment, when nearly one in five patients suffered side effects regardless of which radiation treatment they had.

Yu and colleagues found that proton therapy costs nearly twice as much: $32,428 per course of treatment, versus $18,575 for IMRT. That difference was consistent with that found in other studies.

?The ball is in the court of the proton folks in terms of proving a benefit,? Yu told Reuters Health.

The study only looked at side effects, and did not compare the effectiveness of the treatments, which proton therapy advocates said was a significant weakness.

If Yu is ?willing to make recommendation or clinical judgments based on this sort of data, I think he?s at risk to doing a disservice to his patients,? said Dr. Andrew Lee, director of the Proton Therapy Center at the University of Texas MD Anderson Cancer Center in Houston. ?It?s like trying to read a license plate from 30 thousand feet up in the air.?

Lee, who was not involved in the new work, said that the study?s length - a year - wasn?t enough time to look at the full scope of side effects from either treatment. The study also failed to include side effects that didn?t require a hospital visit, and couldn?t say how long treatments lasted.

Proton therapy isn?t for everyone, both noted. Lee said the treatment was best for young healthy patients, while Yu said it is most useful for cancers in children or in sensitive areas where minimizing the radiation is critical.

Yu would not recommend it for prostate cancer.

?The cancer center next door or the radiation oncologist in the community will likely do just as good a job at treating prostate cancer with IMRT as a proton center three times out of the way,? Yu said.

Proton Versus Intensity-Modulated Radiotherapy for Prostate Cancer: Patterns of Care and Early Toxicity

Results
We identified 27,647 men; 553 (2%) received PRT and 27,094 (98%) received IMRT. Patients receiving PRT were younger, healthier, and from more affluent areas than patients receiving IMRT. Median Medicare reimbursement was $32,428 for PRT and $18,575 for IMRT. Although PRT was associated with a statistically significant reduction in genitourinary toxicity at 6 months compared with IMRT (5.9% vs 9.5%; odds ratio [OR] = 0.60, 95% confidence interval [CI] = 0.38 to 0.96, P = .03), at 12 months post-treatment there was no difference in genitourinary toxicity (18.8% vs 17.5%; OR = 1.08, 95% CI = 0.76 to 1.54, P = .66). There was no statistically significant difference in gastrointestinal or other toxicity at 6 months or 12 months post-treatment.

Conclusions
Although PRT is substantially more costly than IMRT, there was no difference in toxicity in a comprehensive cohort of Medicare beneficiaries with prostate cancer at 12 months post-treatment.

Poll: London Olympics cheered up gloomy Brits

Thousands of people line the streets to applaud British athletes who brought home 185 medals at this year's Games. ITV's Geraint Vincent reports.

More than three-quarters of British people thought the London Olympics did ?a valuable job in cheering up a country in hard times,? according to a new survey.

The Guardian/ICM poll, published Wednesday, found that 78 percent of people agreed the 2012 Games were a good idea, but 20 percent thought the event was ?a costly and dangerous distraction.?

The survey found similar levels of support across different age groups, social class and every region ? apart from Scotland.

But even there 69 percent of people were in favor of the Games, with 31 percent against.

The Guardian newspaper said that a poll last year had reported that 60 percent of people in the U.K. expected Britain to become a more miserable place overall in 2012.

But the new survey found that 49 percent of people thought the U.K. had become a better place to live during the year, with 41 percent believing it had got worse.

The Guardian said the figures suggested ?a positive public take on the Olympics is colouring wider perceptions of the year.?

However the poll also found that 61 percent thought British power in the world had been reduced, with 27 percent saying it had increased. And 51% expected the U.K. would still be struggling with economic problems in 2013.

The paper said ICM Research had interviewed a random sample of 1,002 adults aged 18+ by telephone on 19-23 December 2012.

Elizabeth Dosoretz: When Did Wedding Dress Shopping Become Such A Drag?

Some of my best memories are our girls' shopping weekends. These quick, yet significant getaways were always an opportunity to overindulge, eat, shop, laugh and laugh some more. These trips still happen, but with fianc?s, babies, husbands and work demands, it has been more difficult for the girls to get away alone.

So when my youngest sister sent out a girls-only group email, I couldn't help but smile at the dilemma she described. Abby spoke about her upcoming wedding in August 2013, and that she couldn't possibly pick a wedding dress unless we were all present and all agreed that the dress was "the one." The main issue was that the dress she had her eye on had a "schedule." It was part of a new collection, and thus was traveling to various bridal boutiques as part of a trunk show. (As if our lives aren't complicated enough, we were now trying to catch a glimpse of a traveling dress). In her email, Abby said that she has just found out the dress would be in Miami for a few days, right after Thanksgiving. Because we were all meeting for the holidays in Florida, she wondered if we could possibly sneak away for a quick girls-only day trip to give our opinion on said dress.

I'm not going to lie. I was happy at the thought of getting a break from my daily responsibilities as a wife and mother of three boys. In fact, I was probably the first to reply. We all agreed to go, and before our conscience could get the best of us, we were halfway to Miami.

We're a gregarious bunch, so we walked into the wedding boutique expecting to get somewhat rowdy. Of course, we were all focused on the dress mission, but we were also focused on enjoying our time together. But as soon as I set foot into the upscale boutique, I got a sense that our boisterous group may not be so welcome. First, we weren't exactly dressed the part (I was wearing comfy sneakers and black sweats). Immediately I was struck by the structure and order in the store. I'm not talking about the dresses being hung properly. No, the salesladies all looked, dressed and spoke in the same manner, in fact, I could barely tell them apart. It was like the Stepford Wives: Wedding Dress Edition.

As we waited for my sister to get settled in, we started to take a look around ourselves. I touched the dresses, and started to joke with my older sister and sister-in-law. Some of the dresses reminded me of prom circa 1995, yet others looked like they would be perfect for a cabaret (white feathers galore). The more we perused the wares, the louder our laughs and comments became.

Finally our consultant, Peggy, ushered us behind "the curtain." Almost immediately, we all gasped in unison. The showroom was more like a museum. The dresses were divided by style and craftsmanship, and they were all protected behind a glass door.

Like children, we followed Peggy in a single-file line. She pointed to a smallish couch, told us to sit down, and pulled Abby into a large dressing room. Maybe everyone who shops here follows the same diet routine, but we don't, and we were not able to all fit comfortably on the couch. I took the liberty of sitting on the floor. The showroom was dimly lit and the sales consultants all wore black clothing and stilettos, and their hair was tightly pulled back. Suffice it to say that my Nike sneakers didn't measure up.

Peggy came out first, and like a meal at a fancy restaurant, she began describing in detail each gown that Abby was trying on. I didn't hear a word she said. I was too busy peeking my head into the dressing room to see how Abby looked. We all stared at Abby and waited patiently until we could say what we thought. Even so, we were a bit intimidated by Peggy's description and opinion.

Usually, trying on clothes is a group effort in my family, but not in this instance. Peggy was the official dresser, undresser, hair dresser and apparently, she was the only one who could touch the dresses.

Abby did find her perfect dress and veil. She looked amazing in it, and even though it was probably forbidden, I took many pictures. Then we left and started to unwind from the very stressful shopping excursion we had just experienced. Upon toasting our girls' day with champagne, we vowed to never ever take ourselves or our shopping too seriously.

News Corp Ad Hacking Scandal Alleges Execs ... - Business Insider

Although News Corp.'s latest hacking scandal doesn't involve breaking into the voicemails of deceased school girls or 9/11 victims' relatives, it does allege the corporation used hacking to gain a marketing edge in 40,000 retail stores in the United States.

Courthouse News Service reports that Dial Soaps sued Rupert Murdoch's News Corp.?and its?News America Marketing unit, alleging it?gained an unfair monopoly over?in-store promotions in tens of thousands of retail stores and the free-standing newspaper inserts that touted them.

This monopoly was allegedly done by hacking "customer lists and other marketing materials to solicit its accounts and lock them into News long-term and exclusive contracts."

The suit, excerpted by Courthouse News Service, begins:

"In two distinct relevant markets the multifaceted and pervasive exclusionary strategies of defendants ('News') over twenty years have violated the antitrust laws of the United States. News has suppressed competitive promotion of a massive number of consumer goods in forty thousand retail stores, and scores of newspapers nationwide, to acquire and maintain two unlawful monopolies and earn large monopoly profits at the expense of its purchasers."

A particularly colorful detail in the lawsuit depicts a board meeting in which top execs -- such as former New York Post publisher and NAM boss Paul Carlucci -- allegedly used Al Capone's tactics as a model (emphasis ours):

Its unlawful purposes could not be more transparent. For example, in a sales meeting Paul Carlucci, then News America Inc.'s Chief Operating Officer, ... illustrated News' desire for the ultimate in competitive suppression with a video from 'The Untouchables,' in which Al Capone serves as a sales role model as he cudgels a competitive enemy to death with a baseball bat. Mr. Carlucci has been equally blunt with the press as to News' exclusionary purposes, vowing to 'destroy' his competitors as a 'man who has to have it all.'

Mr. Carlucci threatened to fire any News employee ('concerned about doing the right thing') who did not support exclusive control by News of shelves in retail accounts.?

The lawsuit also accuses News Corp. of:

Using large cash guarantees unjustified by potential in-store promotional revenues to derail competitor contracts with retailers, a practice expressly designed to exclude competitors from these chains; ...?

Defacing competitors' in-store advertisements and then disparaging the quality of the defaced promotions to the retail chains.

Dial's lawsuit also cited News Corp's past cases of breaking competitors' "floor advertising (the late Floorgraphics' Floortalk) or shelf signs with brand price messaging (Insignia's POPSign)."

In 2009, before the British hacking scandal came to light, Floorgraphics (a company that placed ads on supermarket floors) alleged News America?"illegally accessed plaintiff?s computer system and obtained proprietary information? and ?disseminated false, misleading and malicious information about the plaintiff.? The case settled for $29.5 million.

Three years ago, Microsoft CEO Steve Ballmer gave a keynote presentation at the Consumer Electronics Show where he showed off a Slate PC, the company's interpretation of a modern-day tablet.

It wasn't anything special, basically just the regular desktop version of Windows 7 running on a big touchscreen device.?

A few weeks after Ballmer's keynote, Steve Jobs introduced the first iPad, the device that truly kicked off the tablet craze and the one that's still the most popular tablet today.

The subtext here is pretty obvious. Before CES 2010, rumors had been building up about a tablet from Apple. No one knew what to really expect. Would it be the regular Mac software running on a touchscreen? Would it have a DVD drive? Would it cost $1,000? $2,000?

The hype forced the hand of Microsoft and its PC hardware partners, and many cobbled together a bunch of Windows 7 tablet prototypes to show off at CES before Apple could unveil its tablet. Most were vaporware and never launched. And those that did launch did so after the iPad and were largely ignored.

It's happening again.

CES 2013 starts in a few weeks, and the conference's big theme is already emerging. Everyone will be talking about Smart TVs, or web-connected sets with streaming video and apps built in.

Samsung recently teased its new take on the future of television, showing photos of its "Smart Hub" interface on the big screen. LG announced a set that runs on Google TV

Expect that to be the centerpiece of Samsung and LG's CES presentations. And expect to see similar offerings from other TV makers like Panasonic and Sony with interfaces either powered by their own software or Google TV.

Again, it's obvious what's going on here. Rumors about Apple's plans for television just won't die, especially when CEO Tim Cook drops big hints like he recently did in an interview with Brian Williams. Some think it'll be an actual television set with a radical new interface that can replace the clunky one on your TiVo or the box your cable provider gives you. Some think it'll be a new box that can turn any TV into an Apple TV. Maybe it's both.

What we know for sure is Apple is working hard to make the living room its next big thing and that has the competition nervous enough to start cranking Smart TV concepts before Apple can launch its own.?

But it's a dangerous path that can lead to half-baked products that are rushed out just because Big Boy Apple might have plans for a TV later next year.

You're going to see a lot of hype surrounding Smart TVs during the next three weeks or so. It's going to be all anyone can talk about in January. Then it'll fizzle away because the products won't actually launch for several months. Or they'll be too expensive. Or the initial reviews and reactions will be horrible. Or all of the above.

Then Apple will release its own take on TV (whether at the end of 2013 or some time in 2014) and everyone will forget the competition even exists.

It's the Slate PC all over again.

UPDATE: A lot of people seem to think I'm implying Smart TVs are a new thing. They're not. I know they're not. What I am saying is that there will be an intense focus on them during CES and in 2013 as Apple prepares its own new TV product. For example, Samsung has been teasing its new TV for weeks.

(AP) ? Survivors of a Christmas Day crash-landing of an airliner in Myanmar told terrifying tales of escape Wednesday as carrier Air Bagan apologized for what it called the worst accident since it started flying in 2004.

Details of the crash remain unclear but airline officials told a news conference Wednesday that they found the plane's two black boxes and were investigating what went wrong. So far, officials have blamed heavy fog for the aircraft's crash into a rice paddy field where it burst into flames. Two died and 11 were injured, including four foreigners.

The Fokker 100 jet was 21 years old but passed inspections at annual renewals of its air worthiness certificate, the officials said. On Tuesday, it was carrying 71 people, including 48 foreigners, from the city of Yangon via Mandalay to Heho airport, which is the gateway to the popular tourist destination Inle Lake.

"We felt the first bump, then a few big bumps and then (started) sliding very fast," said 31-year-old Australian advertising executive Anna Bartsch. Her boyfriend, Stuart Benson, described the landing like "a roller coaster" ride.

The plane came to a stop and they felt relief ? then panic.

"In my window I saw the flames, and it was hot and we knew straight away we didn't have much time to get out," Bartsch said during an interview at a Yangon hotel where the airline lodged passengers after evacuating them from the scene.

Passengers rushed up the aisle to the front door, which was initially stuck shut, she said.

"We didn't know then that the wings had come off," Bartsch said.

The door was quickly forced open and passengers raced from the plane, some in shock and some suffering smoke inhalation, she said. Once on safe ground, Bartsch said she saw the pilot and co-pilot with bloodied faces and other people with serious burns.

"It's amazing that the injuries were not more serious," she said. "It could have been much worse."

A flight attendant told reporters Wednesday that the crew realized something was wrong only when the plane hit the ground.

"We shouted, 'This is an emergency'," said flight attendant Khaing Su Naing, adding that despite one of the two doors initially getting stuck the crew evacuated the plane 90 seconds after it stopped moving.

The accident has raised concerns about the safety standards of Myanmar's overburdened airlines as foreign visitors have flocked to the Southeast Asian country which is emerging from a half-century of military rule.

Air Bagan is one of a half dozen private airlines that fly domestic routes in Myanmar. After one plane was destroyed in Tuesday's crash its fleet now consists of five planes, including four ATR turboprops and another Fokker 100, which is no longer made.

"We deeply apologize to all our passengers and to their family members," the airline's managing director Htoo Thet Htwe told the news conference. All passengers were paid $2,300, he said.

"This is the most serious accident Air Bagan has ever had," he said. In 2008, one of its planes overshot a provincial airport's runway, spun out of control and crashed, causing the wings and tail to snap off. Many passengers were injured but none died.

Air Bagan has said "the plane hit electrical cables about a mile (1.6 kilometers) from Heho airport as it descended and landed in rice fields."

The Information Ministry said the pilot mistook a road near the airport for the runway before stopping in a nearby rice paddy. It was unclear if the plane made its crash landing on the road or the rice field.

All fatalities were Myanmar citizens, including a man riding a motorcycle where the plane came down and a tour guide aboard the plane. There were earlier reports of an 11-year-old child also among the dead.

Jack Klugman dies in Los Angeles

LOS ANGELES (AP) ? Jack Klugman, the prolific, craggy-faced character actor and regular guy who was loved by millions as the messy one in TV's "The Odd Couple" and the crime-fighting coroner in "Quincy, M.E.," died Monday, a son said. He was 90.

Klugman, who lost his voice to throat cancer in the 1980s and trained himself to speak again, died with his wife at his side.

"He had a great life and he enjoyed every moment of it and he would encourage others to do the same," son Adam Klugman said.

Adam Klugman said he was spending Christmas with his brother, David, and their families. Their father had been convalescing for some time but had apparently died suddenly and they were not sure of the exact cause.

"His sons loved him very much," David Klugman said. "We'll carry on in his spirit."

Never anyone's idea of a matinee idol, Klugman remained a popular star for decades simply by playing the type of man you could imagine running into at a bar or riding on a subway with ? gruff, but down to earth, his tie stained and a little loose, a racing form under his arm, a cigar in hand during the days when smoking was permitted.

He brought a city actor ideal for "The Odd Couple," which ran from 1970 to 1975 and was based on Neil Simon's play about mismatched roommates, divorced New Yorkers who end up living together. The show teamed Klugman ? the sloppy sports writer Oscar Madison ? and Tony Randall ? the fussy photographer Felix Unger ? in the roles played by Walter Matthau and Art Carney on Broadway and Matthau and Jack Lemmon in the 1968 film. Klugman had already had a taste of the show when he replaced Matthau on Broadway and he learned to roll with the quick-thinking Randall, with whom he had worked in 1955 on the CBS series "Appointment with Adventure."

"There's nobody better to improvise with than Tony," Klugman said. "A script might say, 'Oscar teaches Felix football.' There would be four blank pages. He would provoke me into reacting to what he did. Mine was the easy part."

They were battlers on screen, and the best of friends in real life. When Randall died in 2004 at age 84, Klugman told CNN: "A world without Tony Randall is a world that I cannot recognize."

In "Quincy, M.E.," which ran from 1976 to 1983, Klugman played an idealistic, tough-minded medical examiner who tussled with his boss by uncovering evidence of murder in cases where others saw natural causes.

"We had some wonderful writers," he said in a 1987 Associated Press interview. "Quincy was a muckraker, like Upton Sinclair, who wrote about injustices. He was my ideal as a youngster, my author, my hero.

"Everybody said, 'Quincy'll never be a hit.' I said, 'You guys are wrong. He's two heroes in one, a cop and a doctor.' A coroner has power. He can tell the police commissioner to investigate a murder. I saw the opportunity to do what I'd gotten into the theater to do ? give a message.

"They were going to do cops and robbers with 'Quincy.' I said, 'You promised me I could do causes.' They said, 'Nobody wants to see that.' I said, 'Look at the success of "60 Minutes." They want to see it if you present it as entertainment.'"

For his 1987 role as 81-year-old Nat in the Broadway production of "I'm Not Rappaport," Klugman wore leg weights to learn to shuffle like an elderly man. He said he would wear them for an hour before each performance, "to remember to keep that shuffle."

"The guy is so vital emotionally, but physically he can't be," Klugman said.

"We treat old people so badly. There is nothing easy about 80."

The son of Russian Jewish immigrants, he was born in Philadelphia and began his acting career in college drama (Carnegie Institute of Technology). After serving in the Army during World War II, he went on to summer stock and off-Broadway, rooming with fellow actor Charles Bronson as both looked for paying jobs.

He made his Broadway debut in 1952 in a revival of "Golden Boy." His film credits included Sidney Lumet's "12 Angry Men" and Blake Edwards' "Days of Wine and Roses" and an early television highlight was appearing with Humphrey Bogart and Henry Fonda in a production of "The Petrified Forest."

His performance in the classic 1959 musical "Gypsy" brought him a Tony nomination for best featured (supporting) actor in a musical.

He also appeared in several episodes of "The Twilight Zone," including a memorable 1963 one in which he played a negligent father whose son is seriously wounded in Vietnam. His other TV shows included "The Defenders" and the soap opera "The Greatest Gift."

In a 1987 interview in the New York Daily News, he said, "once I did three hourlong shows in 2? weeks. Think we'd do that now? Huh! But then it was great. I did summer stock, played the classics. Me!"

Throat cancer took away his raspy voice for several years in the 1980s. When he was back on the stage for a 1993 revival of "Three Men on a Horse," The Associated Press review said, "His voice may be a little scratchy but his timing is as impeccable as ever."

"The only really stupid thing I ever did in my life was to start smoking," he said in 1996. Seeing people smoking in television and films, he added, "disgusts me, it makes me so angry ? kids are watching."

In his later years, he guest-starred on TV series including "Third Watch" and "Crossing Jordan" and appeared in a 2010 theatrical film, "Camera Obscura."

Klugman's hobby was horse racing and he eventually took up raising them, too.

A horse Klugman co-owned, Jacklin Klugman, finished third in 1980's Kentucy Derby and fourth in that year's Preakness Stakes.

"I always loved to gamble," he said. "I never got close to a horse. Fate dealt me a terrible blow when it gave me a good horse the first time out. I thought how easy this is.

"Now I love being around them."

Klugman's wife, actress-comedian Brett Somers, played his ex-wife, Blanche, in the "Odd Couple" series. The couple, who married in 1953 and had two sons, Adam and David, had been estranged for years at the time of her death in 2007.

In February 2008, at age 85, Klugman married longtime girlfriend Peggy Crosby. His attorney Larry Larson wrote in an email that Klugman is also survived by two grandchildren and that memorial services have not been set.

In 1997, Klugman was sued by an ex-girlfriend, Barbara Neugass, who claimed he had promised to support her for the rest of her life. But a jury rejected her claim.

Japan stocks rally as yen continues to weaken

(AP) ? Japan's benchmark stock index jumped Tuesday as a softening yen helped boost the country's powerhouse export sector. The Nikkei 225 index in Tokyo rallied 1.4 percent to close at 10,080.12, with export shares leading the way.

The yen traded at a 20-month high of 84.95 yen in New York after incoming Prime Minister Shinzo Abe turned up the pressure on the Bank of Japan to adopt a 2 percent inflation target. During a televised program Sunday, Abe said he will consider revising the Bank of Japan Act if the central bank refuses to act at next month's policy meeting, Kyodo News Agency said.

That's designed to fight deflation, or continually dropping prices, which deadens economic activity. The Japanese economy has been stuck in deflation for two decades. On Monday in Asia, the dollar stood at 84.77 yen.

Mazda Motor Corp. gained 2 percent, while Nikon Corp. advanced 2.3 percent. Nomura Holdings jumped 6.3 percent.

Stocks in mainland China posted strong gains. The Shanghai Composite Index jumped 2.5 percent to 2,213.61. The smaller Shenzhen Composite Index surged 2.4 percent to 855.79. Shares in real estate, financial services and travel-related companies led the gains.

Poly Real Estate, China's second-largest listed developer, gained 4.7 percent while industry leader China Vanke soared 6 percent.

Markets in Hong Kong, South Korea, Singapore, the Philippines, Australia and New Zealand were among those closed for Christmas.

On Wall Street on Monday, the last day of trading before Christmas, stocks fell on concern that time is running out for lawmakers to reach a budget deal to avoid the U.S. going over the "fiscal cliff."

The Dow Jones industrial average lost 0.4 percent to close at 13,139.08. The Standard & Poor's 500 index fell 0.2 percent to 1,426.66. The Nasdaq composite index fell 0.2 percent to 3,012.60.

For weeks, discussions between the White House and Congress over a budget deal have been the main driver in markets. If a deal isn't reached by the start of 2013, automatic spending cuts and tax increases worth hundreds of billions of dollars will be imposed ? which many economists think could push the U.S. economy back into recession.

Most markets across Europe were open for only half a day on Monday and won't reopen until Thursday.

As well as monitoring developments in the U.S. over the coming days, investors will be keeping a close watch on what's going on in Italy ahead of a general election in February.

Over the weekend, outgoing Prime Minister Mario Monti indicated that he would be willing to return to the role if pro-reform parties back him. Monti has won praise for his economic reforms and efforts to get a grip on the country's borrowing. Italy has the second-highest debt burden among the 17 EU countries that use the euro. Only Greece's is higher.

Meanwhile, Platts, the energy information arm of McGraw-Hill Cos., said in a report that China's apparent oil demand rose 9.1 percent in November from a year earlier to 42.96 million metric tons, an average of 10.5 million barrels per day, the highest on record.
